WEBINAR (LARCIER) - TAX OPPORTUNITIES AND RISKS IN BUSINESS TRANSFERS
During this webinar, Mr. Stubla will focus on the opportunities (too often unknown and/or poorly mastered) offered by the Walloon, Brussels-Capital and Flemish Regions in relation to the transfer of (family) businesses.
In a synthetic, didactic and comparative way, Maître Stubla will address the scope of the favourable measures granted by the three Regions in order to encourage the transfer of (family) businesses free of charge or at a lower tax cost.
In particular, the following elements will be studied (both for gift and inheritance taxes):
The substantive, formal and maintenance conditions allowing the benefit of these very favorable tax regimes for business transfers;
The sanctions applicable in case of non-compliance with the conditions allowing the benefit of these specific tax regimes for business transfers;
Some selected points of attention in the context of a business transfer.

Tax audits continue to intensify on (small and large) private timeshare owners.
For Airbnb renters, it is not easy to master the legal qualifications and tax regimes applicable to this type of rental, which differ depending on the characteristics of each situation.
The main objective of the webinar is to enable participants to obtain a specific reading grid for income generated via rental platforms to better:
Determine the legal qualification of income received in the context of a rental via a rental platform such as Airbnb;
Understand - through numerical examples - the tax regimes and the different rates applicable to this type of rental;

Within the framework of the Seminar, organized on February 14, 2022, by the Competence Workshops, Mr. Fatmir Stubla is invited to address issues related to the taxation of private real estate investments.
Tax audits have recently intensified on (small and large) private timeshare owners. The main objective of the webinar is to provide participants with a specific reading grid for tax risks in private real estate investment to better:
Determine the real estate operations that are part of or deviate from the "normal management of a private estate";
Determine the legal qualification of income received in the context of a rental via a rental platform such as Airbnb;
Understand the tax regimes applicable to real estate capital gains and/or rental income that are part of the "normal management of a private estate" or not;
Anticipate, control and delimit these tax risks illustrated by the main criteria used by the tax authorities and recent case law;

After having recalled the rules applicable to the matter, the seminar will mainly aim at examining the current state of the jurisprudence in order to clarify the taxable or non-taxable character, and if necessary under which legal qualification, of the operations and of the movable or immovable capital gains that the taxpayer, natural person, could wish to realize. The following questions will be dealt with: - the current characteristics of normal management, - the "natural" consistency of private assets, - the taxable basis and the income-generating event of various revenues, the dividing line between occasional profit-making operations and professional occupations, etc.
