In a webinar organized by Larcier on September 28, 2022, tax lawyer Fatmir Stubla will discuss the tax opportunities and risks involved in transferring businesses
During this webinar, Mr. Stubla will focus on the opportunities (too often overlooked and/or poorly understood) offered by the Walloon, Brussels-Capital and Flemish Regions for transferring (family) businesses.
In a concise, didactic and comparative manner, Maître Stubla will address the scope of preferential measures granted by the three Regions to encourage the transfer of (family) businesses free of charge or at a lower tax cost.
In particular, the following elements will be examined (for both gift and inheritance tax):
The substantive, formal and maintenance conditions for benefiting from these highly favorable tax regimes for business transfers;
The penalties applicable in the event of non-compliance with the conditions for benefiting from these specific tax regimes for business transfers;
A few selected points of attention in the context of a business transfer.

Tax inspections continue to intensify on (small and large) private timeshare owners.
For Airbnb renters, it's not easy to master the legal qualifications and tax regimes applicable to this type of rental, which differ according to the characteristics of each situation.
The main objective of the webinar is to provide participants with a reading grid specific to income generated via rental platforms, in order to better:

Tax audits have recently intensified on (small and large) private timeshare owners. The main objective of the webinar is to provide participants with a specific reading grid for tax risks in private real estate investment, so as to better :
Determine which real estate transactions fall within or outside the scope of "normal management of private assets";
Determine the legal qualification of income received from rentals via a letting platform such as Airbnb;
Understand the tax regimes applicable to real estate capital gains and/or rental income falling within or outside the scope of "normal management of private assets" ;
Anticipate, control and delimit these tax risks, illustrated by the main criteria adopted by the tax authorities and recent case law;

As part of the seminars organized by HEC Liège, Université de Liège, tax lawyer Fatmir Stubla will be sharing his expertise, particularly in the field of real estate taxation.
After reviewing the rules applicable to this area, the seminar will focus on the current state of case law, with the aim of clarifying the taxable or non-taxable nature, and where appropriate the legal classification, of transactions and capital gains on movable or immovable property that individual taxpayers may wish to carry out. Issues such as: - the current characteristics of normal management, - the "natural" consistency of private assets, - the taxable basis and income-generating event for miscellaneous income, the dividing line between occasional profit-making operations and professional occupations, etc., will be addressed.
